Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.

The applicant has preferred the present contempt application for non-compliance of the judgment and order dated 11.09.2014 passed by this court in Writ C No.45019 of 2012 (Safeeq Ahamad Vs. State of U.P. & Others).

By the aforesaid order, the respondents are restrained from interfering in the physical possession of the petitioner over the land in dispute and to restore the entry of the name of the tenure holder.

Pursuant to the order passed by this Court, instructions received from the office of competent authority Prayagraj dated 04.11.2022. It is stated in the instructions that apart from order passed in this writ petition, in various other writ petitions identical order has been passed by this Court against which review applications have been filed.

It is argued by learned Standing Counsel that due to pendency of the review application, no decision has been taken in the matter. It is argued by that nobody is interfering in the physical possession of the petitioner.

Heard learned counsel for the petitioner and perused the record.

From perusal of the record, it is clear that against the judgement and order dated 11.09.2014, a review application has been filed which is pending consideration before this Court.

In the circumstances, the present contempt application is disposed of permitting the applicant to move urgent listing application in the review petition. If such application is filed, the Court concerned is requested to decide the review application as an early date.
