Heard learned counsel for the petitioner and Sri H.N. Pandey, learned counsel for the respondent - Board as well as Sri Gaurav Kumar Upadhyay, learned counsel for the respondent No.-1.

Sri H.N. Pandey, learned counsel for the Board has obtained instructions in the matter which is placed in the Court today and is taken on record.

Sri Pandey submits that school records do not match with the correction which is sought for in the class 10th marksheet of the petitioner and, therefore, Board wrote a letter to the Principal of the institution on 21st May, 2022 to correct first its own record on the basis of the public documents like Aadhar Card, Pan Care, Voter Card and Passport, so that further consequential action may be taken by the Board in the light of the judgment of Supreme Court in the case of Jigya Yadav v. Central Board of Secondary Examination and others; 2021 (7) SCC 535.

In view of the above, this petition stands disposed of with a direction to the petitioner to approach the Principal of the institution, in the first instance, and get the school records corrected by presenting any of the public documents referred to hereinabove within a period of two weeks from today. After necessary correction is carried out by Principal of the institution, then original records be transmitted to the Board within a week and the Board thereafter shall proceed in accordance with law to consider the claim of the petitioner for necessary correction and appropriate decision shall be taken within a further period of two months.
