Heard learned counsel for the petitioner, learned AGA for the State and perused the record.
This petition under Article 227 of the Constitution of India has been filed by the petitioner with a prayer to direct the Principal Judge, Family Court, Jaunpur to decide the Case No. 1350 of 2021 (Poonam Yadav Vs. Saheb Lal), under Section 128 CrPC, Police Station Line Bazar, District Jaunpur within stipulated period.
Learned counsel for the petitioner has submitted that learned Principal Judge, Family Court has passed ex-parte judgment and order dated 28.07.2021, whereby opposite party was directed to pay a sum of Rs. 3,000/- per month to the petitioner but the opposite party had not paid the amount. Thereafter, the petitioner moved an application under Section 128 CrPC on 06.09.2021 for recovery of maintenance amount but since then, said application has been pending and the proceeding has been lingering-on, on one pretext or the other.
In view of the above, learned Principal Judge, Family Court, Jaunpur is expected to make all endeavours to decide the aforesaid case as expeditiously as possible, preferably within a period of four months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid case.
With the aforesaid direction, this petition under Article 227 of the Constitution of India is finally disposed of.
