Application No.78316 of 2010.
1. This application seeks condonation of 1 month and 20 days delay in preferring the revision.
2. I have gone through the application and the affidavit filed in support thereof.
3. Delay has sufficiently been explained.
4. Allowed. Accordingly, the delay is hereby condoned.
Memo
1. This criminal revision, under Section 397/401 CrPC, arises out of judgment and order dated 22.02.2010 passed by the learned Sessions Judge, Barabanki in Criminal Appeal No.02 of 2009, which was filed against the judgment and order dated 03.03.2009 passed by the learned A.C.J.M., Court No. 17, Barabnaki in Complaint Case No.927 of 2000, convicting and sentencing the accused-respondents for the charges levelled against them.
2. By means of the judgment and order in question, the learned trial Court, after considering the evidence on record and taking into consideration the submissions made on behalf of the prosecution and the defence, did not find any offence having been committed by the accused-respondents and, therefore, while setting aside the judgment and order dated 03.03.2009 passed by the trial Court, acquitted the accused-respondents of charges levelled under Sections 323, 352, 452 and 506 (part-ii) IPC by giving benefit of doubt.
3. After perusing the judgment and order carefully, this Court does not find any error of law, fact or evidence, which requires any interference by this Court in exercise of revisional jurisdiction. Thus, the revision fails and is, accordingly, dismissed.
