1. Called in revise. None appeared to press this revision and the delay condonation application. In the circumstances, I myself have perused the record.

2. This criminal revision under Section 397/401 Cr.P.C., has been filed against judgement and order dated 12.12.1997 passed by IXth Additional District Judge, Saharanpur in Criminal Case No.29 of 1995 by which the appeal was dismissed in default which was filed against judgement and order dated 02.08.1995 passed by Chief Judicial Magistrate, Saharanpur in Criminal Case No.201 of 1991 (M/s Sri Finance Versus Shri Ajit Kumar) under Section138 of Negotiable Instrument Act, Police Station Kotwali Nagar, District Saharanpur by which the revisionist was convicted for six months R.I. Being aggrieved, revisionist preferred present revision with delay.

3. This revision has been filed beyond time by 851 days.There is no proper explanation for condonation of delay.

4. Having gone through the record, I do not find any manifest error or otherwise illegality, procedural or otherwise, so as to justify interference in criminal revision.

5. Criminal revision as well as delay condonation application are dismissed.

6. Certify this judgment to the lower Court immediately.
