The present review application has been filed seeking review of the judgment and order dated 13.04.2022.
Learned counsel for the applicant, who is subsequently engaged, was not the counsel when the writ petition was argued. He argues that in terms of The Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order 2016, every member has a right to challenge the allotment if the same is not in conformity with the rules. This aspect was neither argued when the matter was finally decided, thus, in the garb of review, the applicant wants a re-hearing of the matter, which is not permissible in terms of the scope of review as enshrined under Section 114 read with Order 41 CPC.
I do not find any good ground to review the judgment and order dated 13.04.2022.
The review application lacks merit and is dismissed/rejected.
