Rejoinder affidavit filed by learned counsel for the petitioner istaken on record.
Counter affidavit filed by learned Standing Counsel is taken on record.
The grievance of the petitioner is that his result has not been declared only because the relevant column of Answer Booklet which required to be marked in OMR sheet was not marked by the petitioner.
Learned Standing Counsel, Sri Chandan Kumar, has pointed out to the Division Bench Judgment passed in Special Appeal No. 117 of 2014 (Richa Pandey vs. Examination Controller Authority and Others) wherein it has been held that once the mistake has been committed by the candidate in filing the relevant column of the OMR sheet, no further opportunity shall be granted to the negligent candidate.
This court in Special Appeal No. 33 of 2022, Vinay Kumar vs. State of U.P. and Others has held that where relevant column of OMR sheets are not filled it could not be evaluated by OMR software application. Candidates who do not read and follow relevant instructions cannot be granted any permission for subsequent correction in OMR sheet.
In view of the above, the writ petition is dismissed.
