List has been revised but nobody is present on behalf of the applicant whereas Shri Vijay Shankar Mishra, learned Additional Chief Standing Counsel is present for the State.
The applicant is before this Court for a direction to initiate contempt proceedings against the opposite party for wilful disobedience of the judgment and order dated 16.03.2016 passed in Civil Misc. Writ Petition No. 11804 of 2016 (Ashok Kumar Dubey vs. State of U.P. and 2 others) and order dated 28.07.2016 passed in Civil Misc. Contempt Application No. 3647 of 2016 (Ashok Kumar Dubey vs. Mr. Kumar Gaurav, Executive Engineer, Flood Division, Ballia).
From perusal of the record, it appears that either the order of the writ Court has been complied with or the parties have lost their interest.
In the circumstances, it is needless to keep pending this contempt application.
In view of the same, the present contempt application is dismissed.
However, in case, any relief still survives in the present application, the applicant shall be at liberty to file application for revival of the present application.
