Km. Shashi vs State Of U P And Another
2022 Latest Caselaw 2331 ALL

Citation : 2022 Latest Caselaw 2331 ALL
Judgement Date : 7 May, 2022

Allahabad High Court
Km. Shashi vs State Of U P And Another on 7 May, 2022
Bench: Saurabh Shyam Shamshery

HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. - 34

Case :- WRIT - A No. - 6853 of 2022

Petitioner :- Km. Shashi

Respondent :- State Of U P And Another

Counsel for Petitioner :- Amit Kumar Srivastava

Counsel for Respondent :- C.S.C.

Hon'ble Saurabh Shyam Shamshery,J.

Heard Amit Kumar Srivastava, learned counsel for the petitioner and Shri.V.B.Yadav, learned Standing Counsel.

The facts of the present case are squarely covered by the judgment passed by the Supreme Court in the case of State of Uttar Pradesh & Ors. Vs. Pankaj Kumar, (2022) 1 SCC 335, wherein it has been held that the recruitment process would be meaningless without timeline.

The petitioner has failed to submit certificate that she is a dependent of Freedom Fighter before the respondent authorities within the stipulated time. Very vague reason is given by the learned counsel for the petitioner that it was lost in the fire took place wayback in the year 2004. It appears that the petitioner has not taken any steps to get the duplicate certificate of Freedom Fighter issued to his Grand Father in accordance with law.

Learned Standing Counsel submitted that verification is already over regarding the recruitment process for the post of Constable Civil Police and Constable PAC Direct Recruitment October, 2018.

Representation of the petitioner was also rejected by the impugned order dated 15.9.2021 on the ground that he has failed to submit requisite certificates which is not disputed by the learned counsel for the petitioner.

In view of facts and circumstances of the case and also considering the judgment passed in the case of State of Uttar Pradesh & Ors. Vs. Pankaj Kumar, (supra), that process of verification is already over and petitioner has failed to submit requisite certificate and also taking note that petitioner has not taken any steps since 2004, no case is made out which warrants interference by this Court under writ jurisdiction.

The writ petition is accordingly dismissed.

Order Date :- 7.5.2022
