Heard Sri Santosh Kumar Srivastava, learned counsel for the petitioner, Sri Ravesh Kumar Singh, learned Standing Counsel for the State respondents and Sri Bhupendra Narayan Tripathi holding brief of Sri Hari Narayan Singh, learned counsel for respondent No.3.
The present petition has been filed seeking to raise a challenge to an order dated 25.01.2022 passed in a revision arising out of orders passed in mutation proceedings.
Learned Standing Counsel for the State respondents as also the learned counsel appearing for Gaon Sabha have referred to a judgment in the case of Smt. Kalawati vs. State of U.P. and others, reported in 2022 (155) RD 169 to contend that a writ petition arising out of mutation proceedings would not be entertainable.
Learned counsel for the petitioner has not been able to dispute the aforesaid legal position and states that he does not wish to press the petition and that the petitioner would avail the appropriate remedy for the purpose of agitating his rights.
Learned Standing Counsel for the State respondents and learned counsel appearing for Gaon Sabha have no objection to the aforesaid submission.
The petition stands disposed of leaving it open to the petitioner to take recourse to the appropriate legal remedy.
