Judgement Date : 19 December, 2022
HIGH COURT OF JUDICATURE AT ALLAHABAD ?Court No. - 34 Case :- WRIT - A No. - 14319 of 2022 Petitioner :- Aman Kumar Singh Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Gautam,Om Prakash Yadav Counsel for Respondent :- C.S.C.,Pradeep Singh Hon'ble Pankaj Bhatia,J.
Heard learned counsel for the petitioner and Shri Pradeep Singh, learned counsel for the respondents.
The present petition has been filed challenging the order dated 08.08.2022, whereby the contractual services of the petitioner have been terminated.
The counsel for the respondents argues that the contractual appointment of the petitioner was from 07.10.2021 to 06.09.2022, which period has already come to an end.
Learned counsel for the petitioner placed reliance on the judgment in the case of Prem Chandra Gupta Vs. State of U.P. and Others, Special Appeal No. 104 of 2021 and Krishan Kumar Karoliya Vs. State of U.P. and Others, special Appeal Defective No. 417 of 2021 to impress that the writ petition would be maintainable.
The question that arises for consideration in the present case is that term of appointment in terms of the contract has already come to end on 06.09.2022. Thus, no interference, specifically, the reliefs claimed can be granted in the present writ petition, as no right has been said to be violated and no rights prevalent after 06.09.2022.
Petition lacks merits and is dismissed.
