Sri Raj Kumar Gupta,learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Santosh Kumar against the judgment and order dated 01.03.1989 passed by Additional Sessions Judge/Special Judge (E.C. Act), Lalitpur in Sessions Trial No. 64 of 1986, Police Station Mandawara, District Lalitpur.

As per office report dated 10.05.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 03.01.2022 informed that the appellant/Santosh Kumar has died seven years ago. In support of which a report of concerned police station and the copy of death certificate have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
