None appears on behalf of the appellant to press this appeal.

However, Mr. Chandra Shekhar Pandey, learned Additional Government Advocate for the State-respondent is present.

The instant appeal arises out of judgment and order dated 28.04.1988 passed by III Additional District and Sessions Judge, Sitapur in Sessions Trial No. 59 of 1987, arising out of Crime No.158 of 1986, under Section 302 I.P.C., Police Station Rampur Kala, District Sitapur.

Since it is an old appeal, the Registry of this Court has sent a letter to the Chief Judicial Magistrate concerned to know about the living status of the appellant.

As per office report dated 25.02.2022, the Chief Judicial Magistrate, Sitapur has sent a report dated 19.02.2022 whereby it has been mentioned that the sole appellant-Shahadat has died. In support of his report, he has enclosed the report of concerned Police Station and Certificate issued by the Gram Pradhan.

In view of above, the appeal stands abated in respect of the sole appellant-Shahadat.
