This intra court appeal has been filed against the judgment and order dated 17.03.2021 passed by the learned Single Judge in a batch of writ petitions of which the leading petition is Writ-A No.29665 of 2015.

Sri Rakesh Pande, learned Senior Counsel, assisted by Miss Vishakha Pande, learned counsel for the appellants, has stated that the impugned judgment and order dated 17.03.2021 has been set aside on merits, after hearing both sides, by a Division Bench of this Court by its order dated 12.04.2021 passed in Special Appeal Defective No.318 of 2021. He thus submits that this appeal be also decided in terms of the judgment and order of the Division Bench passed in Special Appeal Defective No.318 of 2021, dated 12.04.2021.

Sri Ashish Mishra, learned counsel representing the respondent no.1, does not dispute that the impugned judgment and order of the learned Single Judge has been set aside on merits, after hearing parties concerned, by order dated 12.04.2021 passed in Special Appeal Defective No.318 of 2021.

In view of the above, this appeal is allowed in terms of the judgment and order dated 12.04.2021 passed in Special Appeal Defective No.318 of 2021.
