Heard learned counsel for the petitioner and the learned Standing Counsel for the State.

The petitioner is before this Court with request to issue direction to the respondents to make payment of minimum of the pay scale to him as admissible to regularly appointed Class-IV employees of Horticulture Department in the light of the judgement passed by Hon'ble Supreme Court in the case of Sabha Shankar Dubey vs. Divisional Forest Officer and others, Civil Appeal No.10956 of 2018 decided on 14.11.2018.

Learned Standing Counsel representing the State-respondent states that subject to verification of all facts and contentions on merits being kept open, the claim of the petitioner for payment of minimum in the pay-scale shall be duly evaluated in accordance with law and bearing in mind the judgment of the Supreme Court rendered in State of Punjab and Others v. Jagjit Singh and Others [(2017) 1 SCC 148] and Sabha Shanker Dube Vs. Divisional Forest Officer and Others [Civil Appeal No. 10956 of 2018]. He further states that a final decision shall be communicated with expedition and preferably within a period of four months from the date of presentation of a duly authenticated copy of this order.

Accordingly, without going into the merits of the case or otherwise of the claim of the petitioner, this petition shall stand disposed of in light of the statement noted above.
