HIGH COURT OF JUDICATURE AT ALLAHABAD ?Court No. - 36 Case :- WRIT - A No. - 3699 of 2021 Petitioner :- Satish Chandra Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Rewti Raman Patel Counsel for Respondent :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J.
Petitioner is before this Court assailing the order impugned dated 26.9.2014 passed by the third respondent (Annexure No. 2 to the writ petition) as well as subsequent impugned order dated 29.10.2020 passed by the second respondent (Annexure No. 6 to the writ petition). With a further request commanding the respondents to reinstate the petitioner with all consequential benefits forthwith.
Learned counsel for the petitioner vehemently contended that the petitioner who was initially engaged as Homeguard is aggrieved by the order impugned whereby his services were dispensed with by way of punishment. He submits that the orders impugned is unsustainable in view of the judgment and order dated 11.10.2018 passed by this Court in Writ A No. 16195 of 2005 (Om Beer Singh And Another Vs. State of U.P. And Others).
On the other hand, learned Standing Counsel raised a preliminary objection regarding maintainability of the writ petition on the ground that against the order impugned, the petitioner has got efficacious alternative remedy to file a revision and as such the present writ petition is liable to be dismissed on the ground of statutory alternative remedy.
Confronted with this situation, learned counsel for the petitioner states that the present writ petition may be dismissed as withdrawn with the liberty to approach the revisional authority.
Consequently, the writ petition stands dismissed as not pressed with the aforesaid liberty.
