Counsel for the petitioner is permitted to make necessary corrections in the prayer clause of the petition during the course of the day.

Heard counsel for the petitioner and Sri S.K. Mishra, learned counsel put up his appearance on behalf of respondent no. 3.

The petitioner has preferred the present petition inter-alia with the prayer to direct the Civil Judge (Junior Division) Ghaziabad to decide Execution Case bearing Computer No. 12 of 2021 (Kartar Singh vs. Managing Director U.P.S.I.D.C.) within stipulated period.

It is argued by Sri S.K. Mishra, counsel appeared on behalf of respondent no. 3 that the petitioner has approached before this Court by filing the present petition immediately after the execution case was filed. On the other hand counsel for the petitioner relied upon a judgment and order dated 20.01.2020 passed by the Division Bench of this Court in Writ - C No. 41874 of 2019 (Kartar Singh vs. State of U.P. And 2 Others).

Heard counsel for the parties and perused the record.

In the interest of justice, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the concerned court below to consider and decide the aforesaid execution case in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
