This case is taken up through Video Conferencing.
Learned counsel for applicant and learned counsel for private respondent both, are present. They state that parties have already entered into compromise.
Learned AGA raises preliminary objection that the applicant is required to approach the Sessions Court before moving anticipatory bail application in High Court as per large Bench judgment in the case of Ankit Bharti. Vs. State of U.P. and others. (Criminal Misc. Anticipatory Bail Application No.1094 of 2020) and other connected matters reported in [2020 (3) ADJ 5751].
In view thereof, the applicant is permitted to move appropriate application before the Sessions Court where he can also raise his prayer about the matter being compromised between the parties. In case such an application is filed, the Sessions Court is expected to decide the same expeditiously.
With the aforesaid liberty, the application is consigned to record.
