1. The case is taken up through Video Conferencing.
2. Learned A.G.A. raises a preliminary objection that in view of the Full Bench Judgment of this Court in case of 'Ankit Bharti Vs. State of U.P. and Others' (Criminal Misc. Anticipatory Bail Application No.1094 of 2020) and other connected matters reported in [2020 (3) ADJ 575], the present Anticipatory Bail Application is not maintainable, unless preferred before the Sessions Court.
3. At this stage, learned counsel for applicant prays that he may be permitted to withdraw the present anticipatory bail application with liberty to file the same before the Sessions Court.
4. Learned A.G.A. for the State, Sri D.P. Shahi and Sri Kunwar Ravi Prakash, learned counsels for complainant have no objection to the same.
5. In view thereof, the present anticipatory bail application is consigned to record with liberty as prayed for.
