Case is taken up through video conferencing in terms of order issued by Hon'ble Chief Justice taking into consideration the COVID-19 situation.
Heard.
The present contempt petition has been filed alleging non compliance of the judgment and order dated 18.11.2020 passed by the writ Court whereby the respondent- contemnor was directed to decide the representation of the applicant.
Sri Aniruddh Singh, learned Standing counsel submits that the representation of the applicant has been decided vide order dated 09.04.2021. He further submits that the copy of the order dated 09.04.2021 shall positively be sent to Sri Prabhakar Srivastava, learned counsel for the applicant during the course of day on his E-mail.
Considering the aforesaid, it cannot be said that the respondent-contemnor now runs in contempt to the order passed by the writ Court. Accordingly, the contempt petition is dismissed.
However, the applicant would be at liberty to challenge the order dated 09.04.2021 before the appropriate Court in appropriate proceedings in case he is so aggrieved.
