List has been revised. Nobody is present on behalf of applicants though Sri P. D. Tripathi, learned counsel is present on behalf of opposite party.

The applicants have preferred the present Contempt Petition for non-compliance of the final judgment and order dated 04.02.2020 passed in Writ-C No. 3917 of 2020 (Phulchand And 2 Others vs. State of U.P. And 2 Others). The operative portion of the aforesaid order is reproduced below:-

"We direct the respondent No.2 to consider and decide the application of the petitioners dated 06.10.2019 pending consideration in accordance with law expeditiously, preferably within a period of three months from the date of production of certified copy of this order.

With the aforesaid observation, the writ petition stands disposed of.

It is made clear that the Court has not adjudicated the claim of the petitioners on merits and the District Magistrate is to take decision in accordance with law."

When the aforesaid order was not complied with the present Contempt Petition was filed in which notice was issued to the opposite party on 18.02.2021. Pursuant to the same an affidavit of compliance has been filed by learned Standing Counsel. In paragraph-7 of the aforesaid affidavit it is stated that pursuant to the order passed by this Court necessary action has already been taken by the opposite party on 18.03.2020, copy of which is appended as Annexure-1 to the affidavit of compliance.

In view of the same, no further orders are required to be passed.

Accordingly, the present petition is dismissed as infructuous.
