The petitioners have preferred the present petition under Article 227 of the Constitution of India inter-alia with the prayer to set-aside the impugned judgment and order dated 25.02.2021 passed by Additional District Judge, Court No.6, Agra in Civil Appeal No. 112 of 2020 (Himmat Singh and another Vs. M/s Prem Infracity Pvt. Ltd and Others) and order dated 09.12.2020 passed by Civil Judge (Senior Division) Agra in rejecting the injunction application 8Ga filed in Suit No. 1173 of 2020 (Himmat Singh and another Vs. M/s Prem Infracity Pvt. Ltd and Others) and further be pleased to issue direction to the parties to maintain status quo over land in dispute.

Affidavits have already been exchanged between the parties.

After some arguments, counsel for the petitioners submits that the Civil Judge (Senior Division) be directed to decide the suit itself expeditiously.

Counsel for the opposite parties have no objection.

It is argued by learned counsel for the petitioners that since the matter is pending consideration before the court below for a long time he is suffering irreparable loss.

Heard learned counsel for the petitioners and perused the record.

With the consent of learned counsel for the parties and in the facts and circumstances of the case, without entering into merits of the case, the present petition is disposed of finally with a direction to the court below to consider and decide the Original Suit No. 1173 of 2020 on its turn without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
