This is the 3rd Bail Application moved on behalf of appellant-applicant (husband of deceased) in appeal against the judgment and order dated against the judgment and order dated 24.7.2017 passed by Additional Sessions Judge (Fast Track Court-Ist), Maharajganj in S.T. No.4 of 2000 (State Vs. Matadin Mishra and others), arising out of Case Crime No.214 of 1999, under Sections 498-A, 304-B IPC read with Section 4 of Dowry Prohibition Act,Police Station Brijmanganj, District Maharajganj.

Learned counsel for accused-appellant submits that appellant-applicant is languashing in Jail more than 4 years. He has been wrongly convicted by the Trial Court without appreciation of evidence. Due to heavy pendency of case, there is no possibility of early disposal of appeal. If he is granted bail, he will not misuse its liberty and shall cooperate in the disposal of appeal.

Learned AGA opposed the bail application and submitted that earlier bail applications filed by appellant-applicant have been rejected by the Court on merit. He further submits that Lower Court Record has already been received and file is ready to be decided. Earlier bail application moved on behalf of appellant-applicant have already been rejected by the Court on merit. There is no new ground except detention of appellant-applicant in Jail.

Having considered the rival submissions made by learned counsel for parties, I do not find any good ground to release the appellant on bail. This bail application is, accordingly, rejected.

All the connected appeals are directed to be listed for final hearing on 27 July, 2021 before appropriate Bench.
