This appeal has been preferred against the judgment dated 9.7.2020.
Learned Single Judge has relied on the judgment in the case of Mahendra Singh Vs. State of U.P. and 2 Others (Writ-A No.8535 of 2014 dated 10.2.2020) and directed the respondent to decide the issue of qualifying service for pension after counting his services rendered on temporary basis.
The judgment in the case of Mahendra Singh (supra) was challenged by maintaining Special Appeal Defective No.1003 of 2020 (State of U.P. Through Its Secretary, Foods And Civil Supplies And 2 Others Vs. Mahendra Singh). The said appeal has been dismissed by this Court vide order dated 4.2.2021.
This matter is thus squarely covered by the judgment rendered in Mahendra Singh (supra).
Learned Standing Counsel could not deny the same.
In view of above, this appeal is dismissed and is ordered to be governed by the judgment in the case of State of U.P. Through Its Secretary, Foods And Civil Supplies And 2 Others Vs. Mahendra Singh (Special Appeal Defective No.1003 of 2020) decided on 4.2.2021.
