Sanny Kumar vs State Of U.P. And 4 Others
2021 Latest Caselaw 7148 ALL

Citation : 2021 Latest Caselaw 7148 ALL
Judgement Date : 6 July, 2021

Allahabad High Court
Sanny Kumar vs State Of U.P. And 4 Others on 6 July, 2021
Bench: Ashwani Kumar Mishra

HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. - 33

Case :- WRIT - A No. - 3680 of 2021

Petitioner :- Sanny Kumar

Respondent :- State Of U.P. And 4 Others

Counsel for Petitioner :- Sanjay Kumar Dubey

Counsel for Respondent :- C.S.C.

Hon'ble Ashwani Kumar Mishra,J.

Although petitioner has been selected for appointment on the post of Constable but character certificate has not been issued to him by the District Magistrate on account petitioner's implication in three earlier cases.

It appears that petitioner has also been denied appointment on the basis of his selection in different recruitment which came to be questioned before this Court by the same petitioner in Writ Petition No.7114 of 2020. This petition has been dismissed by a detailed judgment. The offences against the petitioner were same as were the one in earlier petition. Facts being identical and once this Court found the petitioner unfit for appointment on the basis of severity of charges levelled against him a different view is impermissible.

For the reasons recorded in Writ Petition No.7114 of 2020, this writ petition also fails and is dismissed.

Order Date :- 6.7.2021
