Perused the material brought on record.

By way of instant criminal appeal, challenge has been made to the validity and sustainability of the judgment and order of conviction dated 16.11.1988, passed by IInd Additional Sessions Judge, Farrukhabad in Sessions Trial No. 366 of 1984, Police Station - Kamalganj, District - Farrukhabad, whereby the appellants have been sentenced to undergo imprisonment for life under Sections - 364 and 302/34 I.P.C. Both the sentences have been ordered to run concurrently.

From perusal of the report of Chief Judicial Magistrate, Farrukhabad, dated 31.03.2018, which is on the record of this case, it transpires that appellant no.1- Ram Nath, appellant no.2- Daya Ram and appellant no.3- Ganga Ram had died 10 years ago.

In view of above, this appeal is liable to be dismissed as abated.

The present appeal is, accordingly, dismissed.
