Petitioner is engaged as Safai Karmi in the office of respondent no. 4 i.e. Finance & Accounts Officer, Basic Education, Chitrakoot since the year 2015-2016. It is stated that the petitioner is continuously working but is being paid meager sum of Rs. 1000/- per month from the State exchequer.
Learned counsel for the petitioner has placed reliance upon a judgment passed in Writ-A No. 9927 of 2020 ( Chandrawati Devi Vs. State of U.P. and others) decided on 15.12.2020 to submit that the petitioner is entitled to atleast minimum wages fixed for the work being performed by the him. It is stated that petitioner's grievance would be got examined by respondent no.3.
Payment of salary in minimum of pay scale is a statutory obligation on the employer concerned. As the employer in the present case is State, it is expected from the employer to act as a model employer. Claim for payment of wages in terms of the notification issued, fixing minimum wages in similar case, therefore, needs to be examined by respondent no. 3 so as to inquire ensure the minimum salary fixed by law is not denied to the petitioner. The observations made by this Court on 15.12.2020 in the case of Chandrawati Devi shall be duly taken note of, while considering such claim within a period of three months from the date of presentation of copy of this order.
Subject to the observations made above, writ petition stands disposed of.
