Heard learned counsel for the petitioner.
This petition has been filed seeking a direction to the Civil Judge (Senior Division) Banda to decide Rent Case No. 01 of 2010, Jawahar Seth Vs. Vishwa Prakash and others pending before him expeditiously within a stipulated time.
Considering the facts and circumstances of this case, without expressing any opinion on the merits of the case, this petition at this stage stands disposed of with liberty to the petitioner to move appropriate application before the court below for expeditious disposal of the case in the light of Rule 15 (3) of the Rules framed under Act 13 of 1972 and the judgment of the Hon'ble Apex Court in the case of Hameed Kunju vs. Nazim 2017 (8) SCC 611 in which it has been observed that the object of the rent laws all over the State is to ensure speedy disposal of eviction cases between the landlord and tenant and especially those cases where the landlord seek eviction for his bona fide need, which shall be considered and decided sympathetically, as expeditiously as possible, in accordance with law and thereafter the Court may proceed accordingly.
No costs.
