Heard learned counsel for parties.
Sri Raghvendra Pratap Singh learned counsel representing the Basic Education Officer concedes that the claim of the petitioner for release of gratuity in lieu of services rendered by his father in the department has been held back since the requisite option prior to attaining the age of superannuation had not been exercised. He further fairly states that the aforesaid issue stands settled in favour of the petitioner in light of the decision rendered in Usha Rani Vs. State of U.P. And 6 Others[ Writ -A No. 17399 of 2019 decided on 12.12.2019].
In view of the aforesaid this petition shall stand disposed of with a direction to the Basic Education Officer to consider the claim of the petitioner for release of gratuity in accordance with law and bearing in mind the judgment of the Court in Usha Rani. The Basic Education Officer shall endeavour to pass a final order with expedition and preferably within a period of two months from the date of presentation of a duly authenticated copy of this order.
