Petitioner has filed this petition for the shifting of high tension and low tension electric lines to a safe distance from his House No.86 situate in Mohalla Jhungiya Bazar, Gorakhpur.
Learned counsel appearing for the electricity department submits that the road widening programme is under way and that the construction of the petitioner is encroaching the public way. It is for this reason that the aforesaid electricity lines are within the close vicinity of the petitioner's house and if the encroachment is removed, they will be at a safe distance as has been provided under the Indian Electricity Rules, 1956.
The matter requires consideration.
Let a counter affidavit be filed within a month. Two weeks' thereafter is allowed to the learned counsel for the petitioner to file rejoinder affidavit.
List for admission/final disposal after six weeks showing the name of Sri Kapil Dev Singh Rathore as counsel for the respondents.
