It has been stated by the counsel for the petitioners that a counter affidavit was filed by opposite party no. 4 admitting the case of the petitioners as made out in the writ petition. However, the counter affidavit of opposite party no. 4 is not on record. It has been stated at the Bar that the records of the case were misplaced and therefore they were reconstructed. However due to over sight, a fresh copy of the counter affidavit could not be supplied to the office. It has also been stated by the counsel for the petitioners that the counter affidavit was served on him.

The counsel for the petitioners is permitted to file the copy of the aforesaid counter affidavit along with an affidavit of any responsible person from his office to enable the Court to examine the averments made in the counter affidavit.
