The petitioner in both the petitions has preferred the writ petition challenging the order dated 25.5.2017 passed by the respondent no.3 namely District Basic Education Officer, Auraiya, annexure 4 to the writ petition.

Learned counsel for the petitioner contended that the delay has been explained in paragraph 26 of the writ petition. The delay in filing the writ petition is condoned.

Learned counsel for the petitioner contended that the basis of the order impugned is a Government Order dated 2.5.2017, the same has been set aside by this Court in Civil Misc. Writ Petition No.33360 of 2017 (Angad Yadav and 7 others Vs. State of U.P. and 4 others) decided on 19.8.2017. Learned counsel for the petitioner further contended that in terms of the judgement dated 19.8.2017 passed in the case of Angad Yadav (supra) the other similar situated persons were paid their arrears of salary but the petitioner has been discriminated. It is further contended that since the G.O. dated 2.5.2017 has already been set aside, the order is also liable to be set aside and the similar relief be also granted to the petitioner as has been granted in the case of Angad Yadav (supra).

The matter requires consideration.

On the request of Mr. Shravan Kumar Panday, learned counsel for the respondent no.3, ten days' time is granted to seek instructions in the matter.

Put up on 26.3.2019 in the additional cause list.
