Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

The only prayer made by the applicant is that a direction be issued to the court concern to decide the Criminal Case No. 439 of 2008 (State Vs. Nafisul & others) under section 498A, 323 IPC and Section 3/4 D.P. Act in Case Crime No. 26 of 2008, P.S. Bhognipur, District Kanpur Dehat pending in the court of learned Judicial Magistrate, Bhognipur, Kanpur Dehat as expeditiously as possible within the stipulated period.

Considering the facts and circumstances of the case and without expressing any opinion on the merits of the case, this application under section 482 Cr.P.C. is finally disposed of with a direction to the court concern to decide the Criminal Case No. 439 of 2008 (State Vs. Nafisul & others) under section 498A, 323 IPC and Section 3/4 D.P. Act in Case Crime No. 26 of 2008, P.S. Bhognipur, District Kanpur Dehat pending in the court of learned Judicial Magistrate, Bhognipur, Kanpur Dehat in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of one year from the date of production of certified copy of this order, if there is no legal impediment.
