Sri Sudeep Seth, learned counsel for the petitioner has drawn attention of this Court towards order of this Court dated 16.08.2018, whereby this Court has granted four weeks' time to file the counter affidavit. It has further been indicated in this order that in case the counter affidavit is not filed within the time stipulated above, the matter may proceed ex-parte.

As per Sri Seth, this order has been communicated to the learned Assistant Solicitor General of India on 20.08.2018.

This is a matter of Senior Citizen.

Since no counter affidavit has been filed in compliance of order dated 16.08.2018 and this Court had directed that the matter may be heard ex-parte if the counter affidavit is not filed, therefore, list this petition on 03.04.2019 within top five cases for peremptory hearing.
