Heard learned counsel for the petitioners, learned A.G.A. for the State and perused the record.
The present misc. writ petition has been filed to set-aside the order dated 1.2.2019 passed by C.J.M., Basti whereby the permission for process under section 82 Cr.P.C. against the petitioners has been granted and process has been issued in Case Crime No. 717 of 2018, under section 419, 420, 467, 468, 471 IPC and Section 15(3) of Indian Medical Council Act, P.S. Kotwali, District Basti.
Learned counsel for the petitioners submits that the petitioners are ready to appear and surrender before the court below and participate in the proceedings of the trial court.
Considering the facts and circumstances of the case, I do not find any ground to set-aside the order dated 1.2.2019 passed by C.J.M. Basti in the aforementioned case, therefore, the prayer for quashing the same is hereby refused.
However, it is directed that if the applicants appear and surrender before the court below within 30 days from today and apply for bail, their prayer for bail shall be considered and decided in view of the settled law laid by this Court in the case of Amrawati and another Vs. State of U.P. reported in 2004 (57) ALR 290 as well as judgement passed by Hon'ble Apex Court reported in 2009 (3) ADJ 322 (SC) Lal Kamlendra Pratap Singh Vs. State of U.P.
With the aforesaid directions, this writ petition is finally disposed of.
