Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
It is contended by the learned counsel for the applicant that the applicant is a retired teacher aged about 72 years. She was appointed in the year 1979 and has been retired from her service on 30.6.2008. During her service period no complaint was made against the applicant by the college authority or any one and her documents were also not verified. The applicant has not prepared any forged document. She has falsely been implicated in the present case. In fact, no offence is made out against the applicant. The present prosecution has been instituted only for the purpose of harassment.
The matter requires consideration.
Learned A.G.A. has accepted notice on behalf of the State/O.P. No. 1.
Issue notice to O.P. No. 2.
The opposite parties may file counter affidavits within a period of four weeks. Rejoinder affidavit may be filed within a week thereafter.
List thereafter. Till the next date of listing no coercive action shall be taken against the applicant in Case No. 3484 of 2009, State Vs. Smt. Kamlesh Chauhan in Case Crime No. 1354 of 2008, under section 468, 471, 120B IPC, P.S. Katghar, District Moradabad pending in the court of A.C.J.M. 6, Moradabad.
