Learned counsel for the petitioner submitted that the case of the petitioner for regularization and payment of minimum pay scale has been rejected by means of the impugned order dated 28.01.2011 on the ground that the petitioner was not appointed on a Group 'D' post and he was not continuously in service. Therefore, he is not entitled for regularization under the Uttar Pradesh Regularization of Daily Wage Appointment Group 'D' Posts Rules, 2001, while a number of persons, the details of working period of whom have been annexed by the respondent along with the supplementary counter affidavit, have been regularized who were also not working regularly.

Sri D. C. Pathak, learned Additional Chief Standing Counsel prays for and is granted two weeks' time to seek instructions as to when the others have been regularized who were also not working continuously and some of them have not even worked on the alleged date 29.06.1991 and 21.12.2001.
