Case :- WRIT - A No. - 2839 of 2019

Petitioner :- Manu Devi

Respondent :- State Of U.P. And 2 Others

Counsel for Petitioner :- Ghanshyam Chaubey

Counsel for Respondent :- C.S.C.,Ashok Kumar Yadav

Hon'ble Prakash Padia,J.

Heard Mr. Ghanshyam Chaubey, learned counsel for the petitioner, Mr. Jitendra Kumar, learned Standing Counsel, on behalf of respondent nos.1 and 3 and Mr. A. K. Yadav, learned counsel, on behalf of respondent no.2.

Learned counsel for the petitioner contended that petitioner was laborious student and she was well qualified upto graduation. The petitioner is belonging to SC category. The petitioner submitted her online application form to appear in TET-2018. The petitioner was duly allotted roll number by the respondents and thereafter she appeared in the aforesaid examination, which was held in the month of November, 2018. The results of the examination were declared on 4.12.2018 rejecting the candidature of petitioner on the ground "invalid series". It is contended in paragraph 7 of the writ petition that the petitioner has marked each and every column of the OMR-sheet but wholly illegally the candidature of the petitioner has been rejected. In this regard the petitioner has submitted a representation addressed to the respondent no.3, Secretary, Examination Regularity Authority, U.P., Allahabad, copy of which is appended as annexure 6 to the writ petition.

Having heard learned counsel for the parties, the writ petition is being disposed of at the admission stage itself.

In the facts and circumstances, the petitioner is directed to make a fresh representation ventillating all her grievances before the respondent no.3 along-with certified copy of this order within a period of two weeks from today. If such a representation is made, the respondent no.3 is directed to pass appropriate order in accordance with law within a further period of six weeks.

With the aforesaid observations, present writ petition is disposed of finally.

It is made clear that this Court has not entered into the merits of the case and thus it is for authority concerned to take a decision independently in accordance with law.
