Heard Sri S. C. Tripathi, learned counsel for the petitioner. Learned Standing Counsel has accepted notice on behalf of respondent no.1.
Issue notice to respondent nos.2 and 3 returnable at an early date. Steps be taken by speed post within a week.
Learned counsel for the petitioner contended that the order impugned dated 21.1.2019 has been passed in violation of the order passed on 18.1.2018 in Writ A No.41992 of 2016 (Anju Kumari and 4others Vs. State of U.P. and 3 Ors.). It is further contended that the observations made in the case of Km. Pallavi Vs. State of U.P. and others in Writ A No.47490 of 2017 are applicable in respect of all the candidates and not only to the petitioners in the case of Km. Pallavi (supra).
The matters requires consideration.
Counter affidavit be filed by all the respondents within six weeks. Rejoinder affidavit may be filed within two weeks' thereafter.
List immediately thereafter for admission/final disposal.
