Dr. Udai Veer Singh, learned Additional Chief Standing Counsel has filed the supplementary counter affidavit in compliance of order of this Court, today in the Court, the same is taken on record.

During the course of arguments, Dr. Udai Veer Singh, learned Additional Chief Standing Counsel has produced the copy of judgment of this Court rendered in the case of Hari Pal Singh vs. State of U.P. & others reported in [2016 (7) ADJ 655 (LB] submitting that the issue in question is squarely covered with the aforesaid case of Hari Pal Singh (supra), therefore, this case may be decided in terms of the aforesaid judgment of this Court in re: Hari Pal Singh (supra).

Sri Ratnesh Chandra, learned counsel for the petitioner has submitted that he could not go through the aforesaid judgment of Hari Pal Singh (supra), therefore, he may be granted atleast 24 hours time so that he may go through the aforesaid judgment to address the Court.

List/ put up tomorrow i.e. 01.05.2019 in the additional cause list to be taken up at 3:00 p.m.

Interim order, if any, to continue till the next date of listing.
