The petitioner Institution through its Principal has filed the instant petition praying for a mandamus commanding the District Inspector of Schools, Mathura - respondent No. 3 to pass appropriate orders on the application/representation dated 18.9.2018 & 21.1.2019 submitted before him for grant of permission to fill up three vacant posts of Class IV in the Institution as per provisions of Chapter 3 Regulation 101 of the Regulations framed under the U.P. Intermediate Education Act, 1921.

The submission of learned counsel for the petitioner is that no decision has been taken by the respondents in the matter so far.

Learned standing counsel states that respondent Nos. 2/3 shall take appropriate decision in the matter, within such time as may be directed by this Court.

Accordingly, the instant petition is disposed of with direction to respondent No. 3 to transmit the papers to respondent No. 2 for seeking his prior permission, as mandated under Chapter 3 Regulation 101 and soon thereafter pass consequential order in accordance with law. The entire exercise in this regard shall be completed by respondent Nos. 2 & 3 within a period of eight weeks from the date of receipt of certified copy of this order along with photo copy of application dated 18.9.2018 and representation dated 21.1.2019.
