Heard Sri Babhru Vahan Singh, learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
Present writ petition has been filed for issuance of writ of mandamus commanding respondent No. 2- Consolidation Officer, Sagari, District- Azamgarh to decide the Restoration Application dated 09.08.2012 filed by the petitioner in Case No. 177/197 (Rama Shankar Vs. State), within the stipulated time.
The contention of learned counsel for the petitioner is that against the order dated 20.07.2012 the petitioner filed the restoration application on 09.08.2012 which remains pending and has not been decided till date, even after a lapse of more than six years.
Under these circumstances, direction is issued to respondent No. 2- Consolidation Officer, Sagari, District- Azamgarh to decide the Restoration Application dated 09.08.2012 filed by the petitioner in Case No. 177/197 (Rama Shankar Vs. State), in accordance with law, as expeditiously as possible, preferably within a period of three months from the date of production of certified copy of this order.
With the aforesaid direction the writ petition is, accordingly, disposed of.
