Heard learned counsel for the parties.

This Court has passed the order dated 01.03.2019 as under:-

"Supplementary Counter affidavit filed by Opposite Parties pursuant to order dated 13.02.2019, is taken on record.

Heard Sri Yogendra Kumar Mishra, learned counsel for the petitioner and Sri Vinod Kumar Singh, learned Additional Chief Standing Counsel for the Opposite Parties.

In Para 7 of the affidavit, it has been specifically stated that regarding Tubewell Mistries, no seniority list is maintained. However, Rule 18 of Tubewell Mistries Service Rules of 1951 provides for preparation of seniority list of the employees covered under the Rules. As per para 2-a of the impugned order the seniority list has to be prepared division wise.

Accordingly, Opposite Party No.4 is directed to prepare the seniority list of all the Tubewell Mistries in accordance with the Rules applicable within a period of one month from the date of communication of this order.

List after one month."

In compliance of the aforesaid order dated 01.03.2019, the learned Additional Chief Standing Counsel has submitted that the seniority list of all the Tubewell Mistries has been prepared strictly in accordance with rules.

Learned Additional Chief Standing Counsel has further submitted that he may be granted atleast ten days' time to file supplementary counter affidavit bringing on record the said seniority list.

Let the supplementary counter affidavit be filed within a period of ten days. Supplementary rejoinder affidavit, if any, may be filed within a week thereafter.

List this petition on 30.04.2019 within top ten cases.
