Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the material available on record.

This application under Section 482 Cr.P.C. has been filed by the petitioner for quashing of charge sheet no. 120/2009, dated 28.04.2009 with cognizance dated 04-07-2012, order dated 24-09-2018 passed in Case No. 1113 of 2012, Crime No. 67 of 2009, under Sections 147,148,149,307,504,506,427 I.P.C. & Sections 3(1) X SC/ST Act, Police Station-Hasanganj, Lucknow.

After some argument, learned counsel for the petitioner prays that he does not want to press this application, as such, the same is dismissed as not pressed.

However, it is provided that if the petitioner surrenders before the court below within three weeks from today and applies for bail, the court below will consider the same, in accordance with law in view of the observation made in the case of Lal Kamlendra Pratap Singh Vs. State of U.P. reported in [2009 (3) ADJ 322 (SC)]. Till then, no coercive action shall be taken against the petitioner.
