Heard Sri Pradeep Kumar, learned counsel for the petitioner, Sri G.P.Singh, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.

This petition has been filed by the petitioners with a prayer to direct the respondents authority to get the alleged accident in which petitioner's son late Vivek Kumar Singh, I.R.A.S posted as D.F.M/A.D.F.M, North Eastern Railway, Izzat Nagar, Bareilly being Case Crime No.813 of 2017, under Section 279 & 338 I.P.C., Police Station Izzat Nagar, District Bareilly be investigated/ enquired by C.B.I. or some independent agency.

It has been contended by learned counsel for the petitioner that petitioner is the father of the deceased and the FIR was lodged by an Assistant Clerk of the concerned Department where the deceased was working. He further argued that though the petitioner's son died in mysterious circumstances, but the FIR has been lodged showing that it was an accidental death, which is not correct, hence, he has come before this Court for fair investigation by an independent agency and the investigation has not yet been concluded.

Considering the facts and circumstances of the case and submissions advanced by learned counsel for the parties, the S.S.P., Bareilly is directed to ensure that the investigation be conducted by a responsible competent Investigating Officer and the same concluded preferably within a period of eight months from the date of production of a certified copy of this order.

With the above directions this petition is finally disposed of.
