Heard Sri R.P.Singh, learned counsel for the petitioner, Sri Pawan Shukla, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.

This petition has been filed by the petitioner with a prayer to direct the respondent no.2, S.S.P., Gorakhpur to decide the representation dated 19.5.2018 given by the petitioner for transferring the investigation. A further prayer has also been made directing the respondent no.2, S.S.P., Gorakhpur to get fair and proper investigation be done in case crime No.101 of 2018, under Sections 323, 506, 308, 324, 201 I.P.C., P.S. Jhangha, District Gorakhpur.

It has been contended by learned counsel for the petitioner that the petitioner is the informant of the present case. He further submitted that the Investigating Officer of the present case is related to the co-accused persons against whom the petitioner has lodged the FIR, hence, she has come up before this Court for transferring the investigation to another police station and for fair investigation in the matter, as she apprehends that investigation is not being carried out in a fair and proper manner.

Considering the facts and circumstances of the case and submissions advanced by learned counsel for the parties, the S.S.P., Gorakhpur is directed to consider the aforesaid fact and do the needful in the matter.

With the above directions this petition is finally disposed of.
