Sri Durgesh Kumar Tiwari, Advocate holding brief of Sri H.S. Jain, learned counsel for the petitioner, has submitted that since his senior Sri H.S. Jain is out of station today, therefore, this case may be adjourned.

Also Sri Tarun Kumar Mishra, learned counsel for the opposite parties is reported to be out of station, today.

This petition pertains to the year 1992 and has already been dismissed for want of prosecution and an application for restoration/ recall of order is pending.

Bare perusal of the prayers reveals that this writ petition has lost its efficacy and has become infructuous by effluex of time. However, since counsel for both the side are not present, therefore, the case is adjourned.

List this petition in the week commencing 14.01.2019.

It is made clear that the case shall not be adjourned on the next date and if learned counsel for the parties are not available on the next date, they shall make any alternative arrangement.
