Heard the learned counsel for the petitioner and the learned counsel appearing for the U.P. Forest Corporation.

It appears that the petitioner retired from the post of Deputy Logging Officer on 31.7.2016, certain dues of the petitioner remained unpaid and therefore he filed a representation, but the Divisional Logging Manager, Jhansi by an order dated 9.1.2015 determined a recovery of Rs. 4,20,799.75/- against the petitioner. With a further direction that the said amount shall be recovered in installments from the dues of the petitioner.

The petitioner being aggrieved by the order dated 9.1.2015 filed an Appeal on 15.3.2015 before the Managing Director of the U.P. Forest Corporation, Lucknow, the Appeal remains pending till date.

It has been submitted by the learned counsel for the petitioner that the dues of the petitioner remaining to be paid have been detailed in paragraph 22 of the writ petition. This writ petition be disposed of with a direction to the respondents to keep aside Rs. 4,20,799.75 i.e. amount in dispute pending the disposal of the Appeal and release the rest of the amount of retiral dues of the petitioner.

This writ petition is disposed of with a direction to the respondents to keep aside the amount in dispute and pay the rest of the amount if there is no other legal impediment to the petitioner within a period of two months. The Managing Director is directed to decide the Appeal said to be pending before him against the order dated 9.1.2015 in accordance with law within the aforesaid period of two months.

The writ petition is disposed of.
