Heard Sri B.R.Singh, learned counsel for the petitioner.

Learned counsel for the petitioner has submitted that despite the expectation being expressed by the Court vide order dated 19.03.2018 for providing requisite fund to the U.P. Government Employees Welfare Corporation by the State Government, the said order has not been complied with.

Learned counsel for the petitioner has further submitted that the Contempt Petition No.1679 of 2018 has been filed for the reason that the order of this Court has not been complied with and the learned Contempt Court was pleased to direct the petitioner to move an appropriate application before the writ Court as the petition is still pending and accordingly the contempt petition was dismissed vide order dated 13.07.2018.

Further submission of learned counsel for the petitioner is that since vide order dated 19.03.2018 the Court has expressed its expectation but the authorities are not following such expectation in its true spirit.

It is needless to clarify the term legitimate expectation so expressed by the Court and if no counter affidavit has been filed by the State Government nor requisite fund has been provided to the Corporation in question, the petitioner may approach the appropriate forum strictly in accordance with law and also may file appropriate application before the writ Court. However, I find that there is no clarification required in the order dated 19.03.2018.

In view of the above, the aforesaid application is disposed of finally.
