This appeal alongwith an application under Section 372 Cr.P.C. for grant of leave to appeal has been filed against the judgment and order dated 21.2.2013 passed by learned Special Judge (Anti Corruption), Meerut in S.T. No.999/2007 (State Vs.Momin), whereby the applicant has been acquitted of the charges under Sections 363,366,368 and 376 I.P.C.

Heard learned counsel for the applicant and the learned A.G.A. on behalf of the State on the application seeking leave to appeal. 

It is worth mentioning that the State had also filed Government Appeal No.2473 of 2013, State of U.P. Vs. Momin, against the same judgment, which has been dismissed by us today. The same grounds are also applicable to the present appeal. Therefore, leave to appeal cannot be granted.

The application seeking leave to appeal is rejected.

Consequently, the appeal is dismissed.
